This Canadian Privacy Policy provides details regarding how Enel North America, Inc. and its subsidiaries, including Enel Green Power North America, Inc. and Enel X North America, Inc., (collectively, “we,” or “company”) collect, use and disclose Personal Information about Canadian individuals and the rights they have with respect to their Personal Information. 

This privacy policy applies to Canadian individuals from or about whom our company collects Personal Information (collectively, “you” or “your”).
 

What is Personal Information?

References to “Personal Information” in this privacy policy means any information about an identifiable individual or that allows an individual to be identified. Information that is aggregated and/or de-identified and cannot be associated with an identifiable individual is not considered to be Personal Information.

  • Internet or other electronic network activity information, such as IP address, cookie data, browsing history and interactions with our websites, applications, systems and emails. We generally collect this information when you visit our website using cookies or similar technologies. Cookies are small text files that are saved on your computer or mobile device when you visit a website so that information can be saved between visits, such as the geographic region you are accessing our websites from.   • Identifiers such as first name, last name, postal address, email address, account name, phone number, date of birth or other similar identifiers. We may collect this information in various situations, for instance if you contact us with an inquiry or otherwise interact with us. We may also collect other identifiers necessary to conduct counterparty due diligence or “know your client” activities.  

  • Professional or employment-related information such as the name of your employer, your job title/function and business contact information. We generally collect this information when you interact with us in a business capacity and for marketing activities.

  • Demographic information such as marital status. We generally collect this information in connection with legal documents for real estate transactions.

  • Identity documents, such as driver’s license and passport and physical characteristics or identifier description such as gender and date of birth contained in such identification documents. We generally collect this information when performing counterparty due diligence and “know your client” activities (including background checks as permitted by applicable law), to facilitate processing payment to you and for security purposes when you visit our offices. 

  • Commercial information such as signature in agreements entered into with our company, financial details and payment information.

  • Financial and tax information such as credit card number, bank account number, debit card number, invoicing information and information for tax forms, including Social Insurance Number. We generally collect this information to fulfill our commercial transaction with you including to make or receive payment.

  • Audio information captured in recorded calls or any voicemail messages you leave with our company.

  • Visual information, including any photographs you provide as part of your account profile, video surveillance footage that we capture automatically when you visit our locations for the security of our buildings and sites and the safety of our personnel and guests and photographs that we may capture if you attend our events.

  • Geolocation data collected as part of our operations and to provide our services.

  • Inferences drawn from any of the information identified to create a profile about you including reflecting your preferences.

  • Any other Personal Information that you provide to our company.
     

Sources of Personal Information

Personal Information about you is collected from the following sources:

  • Directly from you, such as when you contact us through our online forms, call or email us for support or otherwise provide Personal Information to our company.

  • From our service providers, including software solution providers, data solution providers and leasing agents, who collect your Personal Information on our behalf or provide us with your Personal Information.

  • Publicly available databases and social media platforms, such as professional social media platforms, as permitted by law. 
     

Purpose for Collecting Personal Information

Personal Information about you is collected for the following purposes:

  • to communicate with you;

  • to fulfill the commercial transaction that we enter into with you, fulfill our contractual obligations under the transaction, provide our services, deliver our products, process payments and administer and manage our commercial relationship with you; 

  • to market our products and services and for marketing and business development purposes, such as providing you with marketing materials or information about or related to our company, inviting you to events and webinars, inviting you to participate in ways to support our company and entering you in our company’s prize drawings (if you no longer wish to receive our commercial electronic messages from us, please follow the unsubscribe procedure included in each of these messages);  

  • to detect, monitor and protect against any applicable security incidents;

  • to undertake activities to improve our operations including analyzing the use of our services and products to understand how we can improve our content and service offerings and products, employee trainings, audit functions and research;

  • to conduct internal research for technological development and demonstration;

  • to respond to your inquiries when you contact our company; 

  • to respond to law enforcement requests; 

  • to manage licenses, permits and authorizations applicable to the company’s business operations; 

  • to exercise our legal rights and comply with applicable law and regulations, including to meet our tax, legal and regulatory obligations; and

  • for any other purpose for which you have given your consent.
     

Disclosure of Personal Information

We may disclose your Personal Information as set out below:

  • Within the Enel Group. We may share Personal Information with other entities within the Enel Group, who may use it for the purposes described in this policy. This allows each entity to comply with applicable laws, regulations and requirements and to ensure that your information is consistent, accurate and up to date.

  • Service providers and vendors. We may share Personal Information with organizations that process it on our behalf in order to provide services to us. These service providers and vendors include: marketing, media and community relations consultants and providers, sales providers,  providers of software solutions including document storage software, providers of hosting services, data solution providers, background screening vendors, shipping companies, financial institutions in connection with payment activities, legal advisors and business outsource providers who support our operational activities such as system support, account management and processing payments. 

  • As part of a sale or transfer of our business or other transaction. We may decide to sell or transfer all or part of our business to a third party, merge with another entity, secure our assets or proceed with any other financing or other strategic capital transactions (including insolvency or bankruptcy proceedings), restructuring, share sale or other change in corporate control. We may share your Personal Information when required for the purposes of such a transaction. 

  • Other permitted reasons. We may share your Personal Information when permitted or required by applicable law. This includes sharing your Personal Information with government, quasi-government and regulatory agencies and organizations requesting Personal Information with which our company needs to comply.

  • Changing your communications preferences. You can always choose not to receive marketing or promotional messages from use by email by clicking on “unsubscribe” in any email you receive. Please note that even if you have indicated your choice not to receive commercial messages from us, we may still communicate with you in connection with a service in accordance with applicable law (for example, to send you a customer service message, important product information, service notification or recall). In addition, it may take up to ten (10) business days to register a change of preference across all our records.

Where We Keep Personal Information

Enel North America operates in Canada and the United States and we may share Personal Information within the Enel Group, which has activities in jurisdictions outside of Canada. We may also transfer Personal Information to our service providers outside of Canada. As a result, your Personal Information may be subject to the law of the jurisdiction in which it is transferred, including any law permitting or requiring disclosure of the information to the government, government agencies, courts and law enforcement in that jurisdiction. 
 

Accessing and Correcting your Personal Information

You have the right to access your Personal Information and request the correction of inaccurate information, subject to limited exceptions set out in applicable laws.
